The locator bar controls take up more vertical space than is necessary. There is more than enough room for them on the panel header.

I like the idea but on my standard layouts there is no empty space for them. I don't regularly run with a maximized window ...
I say give the user a choice. In this case the information could not hold.
Just remember that every user choice offers:

I hope we can get votes removed from items that belong elsewhere (resource requests), consolidate similar items so that true priority is reflected etc. ...
Having ui elements disappear when the interface scales down is easy though... It would be a tidy upgrade in my opinion.
I understand that and understand why when there is room, people would like it Although it would make the positioning of the expand/contract icon for the TOC a bit more puzzling. However, I personally hate having UI elements disappear and find that the inconsistency slows the learning curve. But that is a personal bias not an interface rule of thumb.
